O artigo apresenta uma investigação, no âmago do pensamento de Nicolau Maquiavel, sobre o papel que os conflitos romanos ocorridos entre nobres e plebe tiveram para que a República de Roma se tornasse uma potência militar. O entrechoque de desejos de grandes e povo foi responsável por promover naquela cidade um autêntico vivere civile e libero, mas também foi a principal causa de sua expansão político-militar. Aqui, buscaremos elucidar os motivos que alçaram Roma àquela grandeza. Em um primeiro lugar, as (...) dissensões ocasionaram o aperfeiçoamento constitucional das instituições romanas, encaminhando-as rumo a um estado republicano de governo misto. Com a instituição dos Tribunos da Plebe, o povo alcançava seu reconhecimento político, possibilitando que os exércitos fossem formados pelos próprios cidadãos advindos da plebe. Em segundo lugar, a regulação institucional dos conflitos e o anseio expansionista de Roma foram a razão pela qual a "guarda da liberdade" havia sido confiada à plebe, promovendo um governo popular, medida que permitiu que a República se voltasse para campanhas expansionistas em direção a conquista do império. Em terceiro lugar, reconhecer o conflito e institucionalizá-lo foi um meio para precaver-se dos caprichos da fortuna. Dessa forma, regular institucionalmente os eventos que atribulam a ordem política interna significava dar garantias para que os confrontos externos fossem bem-sucedidos. (shrink)

Esta pesquisa analisa alguns tópicos sobre a metodologia de acordo com a filosofia da ciência de Larry Laudan, além de examinar, na área da educação, esta proposta de interpretação filosófica. Trouxemos como elementos algumas considerações e definições sobre a metodologia em Laudan, isto é, da metodologia como um instrumento para a realização da axiologia (que são as metas e os valores cognitivos), porém, apresentando também interessantes relações para com as teorias específicas, como o de justificar as teorias específicas e de (...) ser restringida por elas. A metodologia é também, dentro do modelo reticulado de Laudan, justificada pela axiologia. Para além desta análise, há também uma defesa da metodologia enquanto o estudo dela própria, o que permite encontrarmos conexões interessantes em teorias da educação, como no caso da investigação-ação, onde vemos que estamos diante de uma tradição de pesquisa nos moldes defendidos pela filosofia da ciência de Laudan, por reconhecermos que temos um modelo reticular composto por teorias específicas, metodologias e axiologia também na área da educação. Veremos também que a metodologia em Laudan possui um caráter dinâmico, tensionando e sendo tensionada pelos componentes da tradição de pesquisa, caracterizando o modelo reticulado de racionalidade proposto pelo filósofo. Este debate em Laudan, juntamente com a tradição de pesquisa da investigação-ação da área da educação serão investigados neste artigo. A pesquisa tem como objetivo analisar aspectos/elementos da cosmologia de Aristóteles a partir da filosofia da ciência de Larry Laudan. A tentativa é apresentar neste artigo uma interpretação possível sobre o processo evolutivo da cosmologia da época sob o enfoque da filosofia de Laudan, baseado nas tradições de pesquisa, teorias específicas, modelo reticulado, progresso científico, metodologia, axiologia, etc. Abordaremos sobre a questão da aceitação das teorias específicas, a questão da eficácia na resolução de problemas, entre outras questões importantes para a (...) interpretação mencionada. O recorte histórico será importante enquanto elemento que permitiria visualizar esta interpretação filosófica e sobre como seria possível pensar em um modelo de reticulação neste contexto, na tentativa de apresentar os tensionamentos entre os componentes da tradição de pesquisa, como forma de destacar a necessidade de revisão constante destes elementos historicamente, dentro do processo evolutivo das tradições de pesquisa. O artigo tem por objetivo aprofundar uma abordagem da noção de soberania, segundo análise de obras de Maquiavel estabelecida por Antonio Negri. O autor defende que a soberania para Maquiavel corresponde à sobredeterminação da ação do governante -seja no principado, seja na república- em face das limitações e oposições impostas pelos adversários e pela própria fortuna. Buscamos, assim, entender as características dessa acepção de soberania uma vez que o conceito é definido com exatidão por Jean Bodin, quase meio século após (...) a publicação dos textos maquiavelismos. Para observar essa abordagem, digamos, heterodoxa, da soberania será preciso nos concentraremos na sua tese da relação entre ontologia política e movimento. Para Negri, o movimento é o princípio definidor da política e na obra de Maquiavel se encontra uma concepção de ontologia política produzida e pensada da própria ação do governante no tempo e da qual o movimento é constitutivo e indiscernível. Observaremos como se desenvolve a análise do conflito no caso de cidades como Roma e Florença. Como conclusão pretendemos observar que limites a interpretação das Istorie Fiorentine apresenta à tese negriana da soberania democrática em Maquiavel. (shrink)

A Review of Antonio Damasio's ‘The Feeling Of What Happens: Body and Emotion in the Making of Consciousness’.

After a short description of the major sociological theories based on the concept of risk (Douglas, Beck, Luhmann, Giddens) I propose to integrate the concept of risk with the concept of trust. On a less theoretical level I propose to consider governance as the institutional response to the growing complexity of the risk society. Above all, network governance – that is institutional steering based on a high community participation – seems to give good results in the field of health (...) care policies, as has been shown in the Emilia-Romagna area (Italy). Properties and objects are everywhere, but remain a philosophical mystery. Douglas Ehring argues that the idea of tropes--properties and relations understood as particulars--provides the best foundation for a metaphysical account of properties and objects. He develops and defends a new theory of trope nominalism.

What is truth? What role does truth play in the connections between language and the world? What is the relationship between truth and being? Douglas Edwards tackles these questions and develops a distinctive metaphysical worldview. He argues that in some domains language responds to the world, whereas in others language generates the world.

Although fallacies have been common since Aristotle, until recently little attention has been devoted to identifying and defining them. Furthermore, the concept of fallacy itself has lacked a sufficiently clear meaning to make it a useful tool for evaluating arguments. Douglas Walton takes a new analytical look at the concept of fallacy and presents an up-to-date analysis of its usefulness for argumentation studies. Walton uses case studies illustrating familiar arguments and tricky deceptions in everyday conversation where the charge of (...) fallaciousness is at issue. The numerous case studies show in concrete terms many practical aspects of how to use textual evidence to identify and analyze fallacies and to evaluate arguments as fallacious. Walton looks at how an argument is used in the context of conversation. He defines a fallacy as a conversational move, or sequence of moves, that is supposed to be an argument that contributes to the purpose of the conversation but in reality interferes with it. The view is a pragmatic one, based on the assumption that when people argue, they do so in a context of dialogue, a conventionalized normative framework that is goal-directed. Such a contextual framework is shown to be crucial in determining whether an argument has been used correctly. Walton also shows how examples of fallacies given in the logic textbooks characteristically turn out to be variants of reasonable, even if defeasible or questionable arguments, based on presumptive reasoning. This is the essence of the evaluation problem. A key thesis of the book, which must not be taken for granted as previous textbooks have so often done, is that you can spot a fallacy from how it was used in a context of dialogue. This is an innovative and even, as Walton notes, "a radical and controversial" theory of fallacy. (shrink)

How should we teach controversial issues? And which issues should we teach as controversies? In this paper, I argue that educators should heed what I call a ‘psychological condition’ in their practical efforts to address these questions. In defending this claim, I engage with the various decision criteria that have been advanced in the controversial issues literature: the epistemic criterion, behavioral criterion, political criterion and politically authentic criterion. My argument is that the supporters of these various criteria have focused too (...) closely on the socio-political and epistemic qualities of controversial issues in deriving their controversial issues pedagogies and have thereby overlooked the necessary subjective conditions for teaching controversial issues. If our pedagogical efforts to cultivate students’ reason by means of controversial issues are to be successful, then we must understand controversy as fundamentally a psychological phenomenon consisting in an intellectual tension in the minds of students. In the final pages, I conclude by recommending several forms of directive teaching that promise to be instrumental for creating such intellectual tension. (shrink)

Consequentialism is an agent-neutral teleological theory, and deontology is an agent-relative non-teleological theory. I argue that a certain hybrid of the two—namely, non-egoistic agent-relative teleological ethics (NATE)—is quite promising. This hybrid takes what is best from both consequentialism and deontology while leaving behind the problems associated with each. Like consequentialism and unlike deontology, NATE can accommodate the compelling idea that it is always permissible to bring about the best available state of affairs. Yet unlike consequentialism and like deontology, NATE accords (...) well with our commonsense moral intuitions. (shrink)

Walton's book on the fallacies of ambiguity is firmly at the heart of practical reasoning, an important part of applied logic. There is an increasing interest in artifIcial intelligence, philosophy, psychol ogy, software engineering and linguistics, in the analysis and possible mechanisation of human practical reasoning. Continuing the ancient quest that began with Aristotle, computer scientists, logicians, philosophers and linguists are vigorously seeking to deepen (...) our understanding of human reasoning and argumentation. Significant communities of researchers are actively engaged in developing new approaches to logic and argumentation, which are better suited to the urgent needs of today's applications. The author of this book has, over many years, made significant contributions to the detailed analysis of practical reasoning case studies, thus providing solid foundations for new and more applicable formal logical systems. This paper aims to introduce, in the context of Latin America, the theoretical epistemic discussion regarding the theme of the ‘common’ as a political principle which substantiates instituting and autonomous processes of government, control and community regulation. The work seeks to relate a democratic scenario of the ‘common’ with the discourses of pluralist and decolonial normativity, in a way that would guarantee not only horizontal communal self-management, but also a legitimate ordering of forms of life, founded on common interest, social (...) relations and interconnected structures. For this purpose the instrument of critical-socio-legal analysis is applied at the intersections with the ‘participative-communitary’ type of legal pluralism. Our proposal is to combine the contemporary meaning of the ‘common’, its relation to the Latin American principles of ‘buen vivir’ (living well) and ‘interculturalidade’ (interculturality), as well as the instituting practice of the ‘common’, that engenders a normativity built ‘from below’, which is in opposition to the traditional positivist and state legal system imposed through colonization in Latin America. Such achievements that, although formalized, are not being successful against institutional ruptures, have ‘cloistered’ the practices of the ‘common’ and made the existence of legal pluralism invisible. It is argued that a certain form of the view that the semantic paradoxes show that natural languages are "inconsistent" provides the best response to the semantic paradoxes. After extended discussions of the views of Kirk Ludwig and Matti Eklund, it is argued that in its strongest formulation the view maintains that understanding a natural language is sharing cognition of an inconsistent semantic theory for that language with other speakers. A practical manual for evaluating bias that will be useful to anyone who has to deal with arguments, whether in academic reading or writing, or in everyday conversation.

Douglas N. Walton considers the question of whether the conventions of informal conversation can be articulated more precisely than they are at present. Specifically, he addresses the problem of the fallacy of ad hominem argumentation as it occurs in natural settings. Can rules be formulated to determine if criticisms of apparent hypocrisy in an argument are defensible or refutable? Walton suggests that they can, and ultimately defends the thesis that ad hominem reasoning is not fallacious per se. He carries (...) his analysis to the core of action--theoretic reasoning--by examining a number of specimen arguments. As suggested by the title, the conclusion of ad hominem argument is demonstrated to be relative to the arguer's position. In the appendixes of the book, articles by Gerald McAuliffe and Gordon R. This chapter reviews recent philosophical and neuroethical literature on the morality of moral neuroenhancements. It first briefly outlines the main moral arguments that have been made concerning moral status neuroenhancements. These are neurointerventions that would augment the moral status of human persons. It then surveys recent debate regarding moral desirability neuroenhancements: neurointerventions that augment that the moral desirability of human character traits, motives or conduct. This debate has contested, among other claims (i) Ingmar Persson and Julian Savulescu’s contention that there (...) is a moral imperative to pursue the development of moral desirability neuroenhancements, (ii) Thomas Douglas’ claim that voluntarily undergoing moral desirability neuroenhancements would often be morally permissible, and (iii) David DeGrazia’s claim that moral desirability neuroenhancements would often be morally desirable. The chapter discusses a number of concerns that have been raised regarding moral desirability neuroenhancements, including concerns that they would restrict freedom, would produce only a superficial kind of moral improvement, would rely on technologies that are liable to be misused, and would frequently misfire, resulting in moral deterioration rather than moral improvement. I owe you a dinner invitation, you owe ten years on your mortgage, and the government owes billions. We speak confidently about these cases of debt, but is that concept clear in its meaning? This book aims to clarify the concept of debt so we can find better answers to important moral and political questions. This book seeks to accomplish two things. The first is to clarify the concept of debt by examining how the word is used in language. The (...) second is to develop a general, principled account of how debts generate genuine obligations. This allows us to avoid settling each case by a bare appeal to moral intuitions, which is what we seem to currently do. It requires a close examination of many institutions, e.g. money, contract law, profit-driven finance, government fiscal operations, and central banking. To properly understand the moral and political nature of debt, we must understand how these institutions have worked, how they do work, and how they might be made to work. There have been many excellent anthropological and sociological studies of debt and its related institutions. Philosophy can contribute to the emerging discussion and help us to keep our language precise and to identify the implicit principles contained in our intuitions. (shrink)

This paper addresses the problem posed by the current split between the two opposed hypotheses in the growing literature on the fallacy of begging the question the epistemic hypothesis, based on knowledge and belief, and the dialectical one, based on formal dialogue systems. In the first section, the nature of split is explained, and it is shown how each hypothesis has developed. To get the beginning reader up to speed in the literature, a number of key problematic examples are analyzed (...) illustrating how both approaches can be applied. Useful tools are brought to bear on them, including the automated argument diagramming system Araucaria, and profiles of dialogue used to represent circular argumentation in a dialogue tableau format. These tools are used to both to model circular reasoning and to provide the contextual evidence needed to properly determine whether the circular reasoning in a given case is better judged fallacious or not. A number of technical problems that have impeded the development of both hypotheses are studied. One central problem is the distinction between argument and explanation. It is concluded that the best way to move forward and solve these problems is to reformulate the two hypotheses in such a way that they might be able to co-exist. On this basis, a unified methodology is proposed that allows each hypothesis to move forward as a legitimate avenue for research using the same tools. (shrink)

A useful contribution to theories of argumentation and public address criticism, this book uses a pragmatic approach to understanding conversation as a way of elucidating the use of appeals to pity and sympathy.

Science is one of the most important forces in contemporary society. The most reliable source of knowledge about the world, science shapes the technological possibilities before us, informs public policy, and is crucial to measuring the efficacy of public policy. Yet it is not a simple repository of facts on which we can draw. It is an ongoing process of evidence gathering, discovery, contestation, and criticism. I will argue that an understanding of the nature of science and the scientific process (...) should be the central goal for scientific literacy, rather than a grasp of specific (often disciplinary) facts. With this understanding of science as a backdrop, the paper then turns to modes for citizen engagement with science. This paper articulates different ways citizens can engage with science, including four avenues for legitimate contestation of scientific claims. I then look more closely at contestation of science on the basis of values. That science can be legitimately contested by non-experts on a range of grounds means that science communication should not just aim at getting citizens to accept scientific claims, but rather to engage in a more robust two-way conversation about science. Argumentation schemes are forms of reasoning that are fallible but correctable within a self-correcting framework. Their use provides a basis for taking rational action or for reasonably accepting a conclusion as a tentative hypothesis, but they are not deductively valid. We argue that teleological reasoning can provide the basis for justifying the use of argument schemes both in monological and dialogical reasoning. We consider how such a teleological justification, besides being inspired by the aim of directing a bounded cognizer to (...) true belief and correct choices, needs to take into account the attitudes of dialogue partners as well as normative models of dialogue and communicative activity types, in particular social and cultural settings. Nascida como um promissor início de amizade entre dois amantes da verdade, a correspondência entre Espinosa e Blyenbergh revelou-se uma verdadeira desilusão. Por conhecerem a verdade por caminhos diversos, nas línguas de Espinosa e de Blyenbergh, as palavras _Deus_ e _mal_, que sustentam toda a problemática da correspondência, só poderiam significar coisas completamente diferentes. Apesar de ambos concordarem que Deus é sumamente perfeito e a causa de todas as coisas, enquanto um concebia que homens e mulheres poderiam contrariá-lo, entristecendo-o a (...) ponto de puni-los por isso, o outro compreendia que Deus não é senão perfeição absoluta. Enquanto um concebia o mal como uma privação do bem, para o outro, ele nada é. Por isso mesmo, Espinosa e Blyenbergh jamais poderiam comunicar-se entre si pela linguagem dos filósofos, condição necessária para unirem-se pelo amor à verdade. (shrink)

_Discusses philosophers Mencius and Aristotle as socio-ecological thinkers._ Mencius (385–303/302 BCE) and Aristotle (384–322 BCE) were contemporaries, but are often understood to represent opposite ends of the philosophical spectrum. Mencius is associated with the ecological, emergent, flowing, and connected; Artistotle with the rational, static, abstract, and binary. Douglas Robinson argues that in their conceptions of rhetoric, at least, Mencius and Aristotle are much more similar than different: both are powerfully socio-ecological, espousing and exploring collectivist thinking about the circulation of (...) energy and social value through groups. The agent performing the actions of _pistis_, “persuading-and-being-persuaded,” in Aristotle and _zhi_, “governing-and-being-governed,” in Mencius is, Robinson demonstrates, not so much the rhetor as an individual as it is the whole group. Robinson tracks this collectivistic thinking through a series of comparative considerations using a theory that draws impetus from Arne Naess’s “ecosophical” deep ecology and from work on rhetoric powered by affective ecologies, but with details of the theory drawn equally from Mencius and Aristotle. This article serves as an introduction to the collection of papers in this monographic issue on "What the European tradition can teach about Corporate Social Responsibility" and presents the rationale and the main hypotheses of the project. We maintain that corporate social responsibility (CSR) is an ethical concept, that the demands for socially responsible actions have been around since before the Industrial Revolution and that companies have responded to them, especially in Europe, and that the content of CSR has evolved (...) over time, depending on historical, cultural, political, and socio-economic drivers and particular conditions in different countries and also at different points in time. Therefore, there is not — and probably cannot be — a unique, precise definition of CSR: one global standard for CSR is unlikely. (shrink)

Argumentation schemes are forms of argument that capture stereotypical patterns of human reasoning, especially defeasible ones like argument from expert opinion, that have proved troublesome to view deductively or inductively. Much practical work has already been done on argumentation schemes, proving their worth in A1 [19], but more precise investigations are needed to formalize their structures. The problem posed in this paper is what form justification of a given scheme, as having a certain precise structure of inference, should take. It (...) is argued that defeasible argumentation schemes require both a systematic and a pragmatic justification, of a kind that can only be provided by the case study method of collecting key examples of arguments of the types traditionally classified as fallacies, and subjecting them to comparative examination and analysis. By this method, postulated structures for schemes can be formulated as hypotheses to solve three kinds of problems: (1) how to classify such arguments into different types, (2) how to identify their premises and conclusions, and (3) how to formulate the critical questions used to evaluate each type of argument. Argument invention is a method that can be used to help an arguer find arguments that could be used to prove a claim he needs to defend. The aim of this paper is to show how argumentation systems recently developed in artificial intelligence can be applied to the task of argument invention. One such system called Carneades is featured. Carneades can be used to analyze arguments, evaluate arguments, to make an argument diagram, and to construct arguments from a database.
